Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or other non-excludable statutory protections. Where such liability cannot be lawfully excluded, our liability is limited, at our election, to the resupply of the relevant services or the cost of having those services resupplied.

8. Commercial Client Engagements

Agentic Merchant designs and engineers bespoke autonomous agent architectures, generative AI integrations, and synthetic labor workflows for commercial clients.

The execution of any technical audit, software engineering, proof-of-concept, or deployment engagement is strictly governed by a separate, formally executed Master Services Agreement (MSA) and/or Statement of Work (SOW) entered into between you and Agentic Merchant. These Terms of Use do not govern commercial development engagements beyond your informational and exploratory use of this Site.

9. Changes to These Terms

We reserve the right to review, update, or modify these Terms of Use at any time without prior notice. Any modifications will be posted directly to this page with an updated revision date. Your continued access to or use of the Site following any changes indicates your acceptance of the revised Terms.

10. Governing Law & Jurisdiction

These Terms of Use, and any dispute, controversy, or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
